These Terms and Conditions shall apply to all contracts for the sale of Goods by Shen Jewellery (the Seller ) to the you (the Buyer) and shall prevail over any other documentation or communication.  Placing an order shall be deemed conclusive evidence of your acceptance of these Terms and Conditions.  Nothing in these Terms and Conditions shall affect your statutory rights as a Consumer.

A. Pricing Information

Product prices on the website are given in pounds sterling and are inclusive of postage and packaging costs.  Product prices shown exclude VAT and because Seller is currently not subject to charge VAT on its sales, VAT will not be added to any price.   The total purchase price, including any taxes and delivery charges, if any, will be displayed in Buyer's shopping cart prior to confirming the order.  All orders are payable in pounds sterling.

B. Weights & Sizes

All weights and sizes included in product descriptions are given for guidance only.  All photographs are for reference purposes and not to scale.  Due to natural variations, the patterns and colour shades of some gem stones may slightly differ from those shown .

C. Availability

All products advertised on the Seller's website will be despatched from stock and are therefore subject to stock availability.    Confirmation of product availability will be provided when an order is placed online.  Should the Buyer's order be urgent, the Seller recommends that the Buyer contact the Seller first to verify product availability at sales@shenonline.co.uk.  Any stock availability details given on the website is for information purposes only and not binding.

D. Order & Payment

In order to place an order the Buyer must be over 18 years of age and be the authorised user of a valid credit or debit card issued by a bank that is accepted by the Seller.  The Seller is unable to process payment for orders made on the website by either cash, cheque or postal orders.  For all orders the Seller requires both an email address, telephone number and valid mainland address for delivery within the UK mainland to assist in the delivery of goods to the Buyer.  The Seller is unable to accept any order whose delivery address is to a P.O. box or out with the UK mainland.

 

Payment can be made using all major credit and debit cards or a PayPal account. The Seller uses PayPal to securely process all online debit/credit card payments.  Payments made through PayPal will be entered via PayPal's secure web server, and the information provided by the customer will be encrypted, so that it can not be read or intercepted. A PayPal account is not required to make a payment using a debit or credit card.

 

When an order is received, the Seller shall confirm by email the details, description, availability and price for the Goods together with information on the Buyer's right to cancel. 

 

The Seller retains the right to refuse any request made by the Buyer and if the Seller discovers an error in the price or details of any goods which the Buyer has ordered, the Seller will inform the Buyer of this as soon as possible and give the Buyer the option of reconfirming their order at the correct price and details, or cancelling the order.  Should the Seller not be able to contact the Buyer or receive a reply within 7 working days, the Seller will treat the order as having been cancelled by default.  If the order is cancelled and the Buyer has already paid for the goods, the Buyer will receive a full refund within 30 days.

E. Delivery

Unless otherwise stated, all delivers will be made using Royal Mail Next Day Special Delivery service.  The Buyer will be emailed the Royal Mail tracking code when the order has been dispatched.  A signature will be required for all deliveries and we ask that arrangements be made for someone to be available at the shipping destination to sign for receipt.   However if the Buyer is unable to do so, Royal Mail will leave a calling card instructing you how the Buyer can collect their order from the local delivery office or alternatively re-arrange delivery at a time and place convenient to the Buyer.

 

No goods will be despatched until full payment has been confirmed as received and cleared by PayPal.  Goods in stock are normally despatched within 3 working days of full payment.  Delivery of pieces made to specific order may however take longer and delivery times will vary dependant upon the availability of items within the design of each piece.  Expected delivery times of pieces made to specific order will be given prior to placing of the order.

 

Any item that is out of stock will be despatched as soon as it becomes available within 30 days.  If the Seller is unable for any reason able to despatch the goods within 30 days of the order being placed, the Seller will contact the Buyer as soon as they become aware of this and provide a revised delivery date or the option to cancel the order.    If the order is cancelled and the Buyer has already paid for the goods, the Buyer will receive a full refund within 30 days.  If the Seller is unable to contact the Buyer or not receive a response within seven working days, the Seller will treat the order as cancelled by default.

 

If the order can not be delivered to the address given by the Buyer and the order is subsequently returned to the Seller, the Buyer will receive a refund of any payment made less delivery costs equivalent to delivery by made by Royal Mail Next Day Special Delivery.

 

Any delivery date given will be an estimate and the Seller shall use its reasonable endeavours to meet any date agreed for delivery. In any event, time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

F. Cancellation & Returns

The Seller trusts that the Buyer will be pleased with their purchase, however if the Buyer is dissatisfied with an item for any reason, the Seller is happy to help with an exchange or refund.  The Buyer must inform the Seller in writing as soon as possible within 7 days from receipt of the order otherwise it will be deemed that the Buyer has accepted the Goods.  The email address that can be used for returns is returns@shenonline.co.uk.  Returned goods must be returned by the Buyer to the Seller within 14 workings days from the date of receipt of the goods at the Buyer’s expense. 

 

All items being returned shall remain the responsibility of the Buyer until it reaches the Seller.  It is recommended for the Buyer's protection, that parcels be sent using a recorded delivery service that provides insurance for the value of the goods.  Goods being returned must clearly show the order number obtained from the Seller on the package.

 

No item will be accepted without prior arrangement being made in writing and the goods must be fit for sale on their return as they were on delivery. Items must be returned in original packaging, all original boxes, packing materials and the original attached hoop and tags.   Where returned Goods are found to showing signs of wear, alteration or damage due to the Buyer’s fault, the Buyer will be liable for the cost of remedying such damage. 

 

The Buyer will receive a refund of all monies paid for the goods within 30 days (including delivery charges, if any) except for return postal charges and repair costs (if any).  Unless damaged in transit to the Buyer, the Seller is unable to accept the return of earrings for hygiene reasons nor pieces made to Buyer's specific requirements.

G. Warranty

The Seller warrants that the goods comply with the description given on the order form and that they are free from material defect at the time of delivery.  The Seller gives no other warranty to (and exclude any other warranty, term or condition that may be implied) as to the quality of the goods or their fitness for any purpose.  No warranty is given by the Seller in relation to any associated perceived effect that have been given to various minerals and gems given by many different traditions throughout the ages. 

 

If the Buyer believes that that the Seller has delivered goods that are defective in materials or workmanship, the Buyer must inform the Seller in writing as soon as possible and return the goods to the Seller for inspection.  The email address that can be used for returns is returns@shenonline.co.uk.  The piece item code and payment Transaction ID should be included in the correspondence.

 

If where upon inspection the Seller accepts that the goods are defective in materials or workmanship, the Seller will (at their option) repair or replace the item.  If the seller is unable to repair or provide a replacement item, the Buyer will receive a full refund for the cost paid for the item within 30 days. 

 

Where the Seller accepts that the goods are defective in materials or workmanship, the Buyer will be refunded any return postal charges they incurred to return the defective or damaged item equivalent to no more than that of Royal Mail Next Day Special Delivery service.

H. Waiver

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

I. Force Majeure

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

J. Changes To Terms And Conditions

The Seller shall be entitled to alter these Terms and Conditions at any time. but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase, unless agreed in writing by both parties.
